Houston Bicycle Accident Attorneys Near You

Bicycles don’t come with airbags, crumple zones, or a steel frame between the rider and the road, so even a crash a driver might shrug off as minor can leave a cyclist with a fractured wrist, road rash down to muscle, or a concussion that doesn’t show symptoms until hours later. Insurance adjusters don’t always see that gap. A bicycle claim can get filed, valued, and closed the same way as a fender-bender, and that mismatch is where a lot of injured cyclists end up shortchanged.

At Goldenzweig Law Group, PLLC, founding attorney Stephen Goldenzweig spent over 16 years building a career that started on the other side of these claims: defending insurance companies before he started representing injured cyclists and drivers himself. He’s a graduate of Hofstra University School of Law, is licensed to practice in both Texas and New York, and has been named to the Super Lawyers Rising Stars list for five consecutive years. Below is what actually shapes a Houston bicycle accident claim: the laws that apply, what usually causes these crashes, and where insurers tend to cut corners.

We have helped countless bike accident victims file claims against negligent motorists and other liable parties to recover the full, fair compensation they deserved.

Why Insurance Companies Downplay Bicycle Accident Injuries

Adjusters have a few go-to moves on bicycle claims. One is treating a lack of vehicle damage as a sign the impact was minor, when a cyclist absorbs force with their body instead of a bumper. Another is suggesting the rider shares the blame for “not being in the bike lane” or “not wearing a helmet,” even when neither is legally required on most Houston roads. A third is moving fast on a low offer before the full extent of a soft-tissue or head injury has shown up on imaging. None of these tactics reflect what the law actually requires, but they work often enough that insurers keep using them.

Texas Bicycle Laws You Should Know

The state of Texas has several important bicycle laws that anyone who rides a bike or shares the road with cyclists should know.

Some of these laws include:

  • Bicycles are recognized as “vehicles” and, therefore, cyclists are granted the same rights and responsibilities as any other vehicle operator on the road
  • Cyclists have the right to use the full lane when necessary but, whenever possible, should ride as far to the right side of the road as possible and/or use bicycle lanes when available
  • When passing or overtaking a bicyclist on the roadway, motorists should always leave at least three feet of space between their vehicles and cyclists
  • Bicyclists should know and use appropriate arm and hand signals to alert other vehicle operators of their intentions, such as turning or stopping
  • Bicyclists may ride two abreast (side by side) as long as they do not impede traffic (with exceptions for racing and taking lanes)
  • If a bicyclist wishes to ride at night, their bike must be equipped with a white light on the front and a red light or reflector on the back
  • In most areas, it is illegal to ride a bicycle on the sidewalk; however, this depends on the municipality, and there may be some exceptions

Currently, there are no laws in Texas requiring bicyclists of any age to wear helmets when riding. However, wearing a safety helmet is the best way to avoid severe head and brain injuries, as well as facial injuries, in the event of a crash. It is strongly recommended that all cyclists always wear an approved bicycle helmet when riding.

What Are the Most Common Causes of Bicycle Accidents?

Most bicycle crashes trace back to driver behaviour rather than anything the cyclist did. Distracted driving is a constant factor; someone glancing at a phone for even two seconds at 35 miles per hour covers over 100 feet blind. Failure to yield at intersections and driveways is another common cause, along with drivers making a “right hook” turn directly across a cyclist’s path. Doors opened into a bike lane without checking mirrors first, sometimes called dooring, cause serious crashes that many drivers don’t even realise are a traffic violation. Add in aggressive or reckless driving, tailgating, and roads with potholes or poor lane design, and you get a fairly predictable list of what actually puts riders in the hospital.

Some specific examples of common bicycle accident causes include:

  • Careless and distracted driving
  • Texting or using a cellphone while driving
  • Driving under the influence of alcohol or drugs
  • Failure to yield the right of way
  • Aggressive or reckless driving
  • Following too closely, or “tailgating”
  • Drowsy or fatigued driving
  • Unsafe or illegal turns
  • Dangerous passing and lane changes
  • Opening vehicle doors into cyclists
  • Driving or parking in designated bike lanes
  • Failure to properly share the road

Establishing Liability After a Houston Bicycle Accident

To recover damages after a crash, you have to establish that someone breached a duty of care, meaning a legal obligation to act reasonably and avoid foreseeable harm, and that the breach caused your injury. A driver who runs a red light or drives drunk has clearly broken that duty. Texas follows a proportionate responsibility system under Civil Practice and Remedies Code Section 33.001: your recovery gets reduced by your percentage of fault, and you’re barred entirely if a jury finds you more than 50 per cent responsible. That’s exactly why insurers push the “no helmet, no bike lane” argument even where it has no legal basis; it’s an attempt to shift blame onto you before a case ever gets that far. Texas also gives you two years from the date of the crash to file a lawsuit under Civil Practice and Remedies Code Section 16.003, so claims that drag on with a slow insurer still need attention paid to that clock. If the crash caused a catastrophic injury or a death, talk to a wrongful death lawyer early, since the stakes and the evidence you need only grow with time.

Coverage You May Not Know You Have

One thing that surprises a lot of injured cyclists: your own auto insurance may already cover you, even though you weren’t in a car. Personal Injury Protection, or PIP, is tied to the policyholder and their household, not just to whoever is occupying the insured vehicle. If you or someone in your household carries an auto policy with PIP, that coverage generally extends to you as a cyclist hit by any vehicle, not just the one named on the policy. Texas insurers must offer at least $2,500 in PIP per person unless it was rejected in writing, and it pays medical bills and a portion of lost income regardless of who caused the crash. It also doesn’t reduce what you can later recover from the driver who hit you.

Who is Liable after a Bike Accident in Houston?

If you were injured in a bicycle accident, you could be entitled to financial compensation for your medical bills, lost wages, pain and suffering, lost earning capacity, and other damages. To have a case, however, you must first establish liability. That is, you must determine who is legally responsible for paying your damages.

Determining who is liable for your bike accident typically involves identifying the at-fault party. Whoever caused the incident, whether directly or indirectly, is also likely the liable party. This is because, by causing the accident, the at-fault party likely breached a “duty of care,” or legal responsibility to take reasonable measures to prevent foreseeable harm.

For example, all motorists have an implied duty of care to others on the road. They must obey the law and refrain from engaging in risky behaviors that increase the likelihood of a crash. So, when a motorist chooses to get behind the wheel after consuming several alcoholic beverages, they are not only breaking the law but also engaging in behavior that is known to be dangerous. If the drunk driver causes an accident, leading to bodily injury or death, they can be held liable.
